Claimant, Youras Ziankovich, hereby expressly reserves all rights, claims, and defenses in connection with this arbitration proceeding.

Claimant does not concede the existence, validity, or enforceability of any alleged arbitration agreement with Respondent. Claimant denies that he entered into any valid and binding agreement to arbitrate disputes with Respondent.

Claimant participates in this arbitration solely pursuant to the Order of the United States District Court for the Southern District of Texas compelling arbitration. Such participation is involuntary and undertaken under protest.

Nothing in Claimant’s Demand for Arbitration, Statement of Claims, or any participation in this proceeding shall be deemed or construed as:

  • an admission that a valid arbitration agreement exists;
  • a waiver of any objections to arbitration;
  • a waiver of any jurisdictional defenses;
  • a waiver of any rights to challenge the enforceability or scope of any alleged arbitration agreement; or
  • a waiver of any rights, claims, or defenses available under applicable law.

Claimant further reserves the right to challenge the arbitration process, the jurisdiction of the arbitrator, and any award issued in this proceeding in any court of competent jurisdiction.
